Facts
Jagger Brothers (defendant) contracted to buy 20,000 pounds of yarn from Technical Textile Company (plaintiff) for $2.15 per pound. Technical had delivered 3,723 pounds of yarn when Jagger repudiated the contract and advised that it would not accept any further deliveries. Technical brought suit for breach of contract. The trial court found that the market price of yarn as of the date of breach was $1.90 per pound. Based on this, the trial court awarded Technical $4,069.25. The award equaled the difference between contract price and market price ($0.25 per pound), multiplied by the number of pounds not delivered. Jagger appealed, arguing that the damages amount should be the difference between the cost of manufacture and the market price.
