James v. Grand Trunk Western Railroad Co.
Illinois Supreme Court
14 Ill. 2d 356 (1958)
- Written by Josh Lee, JD
Facts
James (plaintiff) filed a lawsuit in Illinois against the Grand Trunk Western Railroad Company (defendant), alleging wrongful death. The underlying accident occurred in Michigan, and James was a Michigan resident. Grand Trunk was an Illinois railroad company. After the Illinois lawsuit was filed, Grand Trunk then filed a separate lawsuit against James in Michigan. Grand Trunk alleged that the Michigan venue statute required James to file the lawsuit in Michigan. The Michigan trial court entered an injunction against James, restraining him from further prosecuting the Illinois lawsuit. James then requested the Illinois trial court to enter an injunction preventing Grand Trunk from enforcing the Michigan injunction. The trial court denied the request, and James appealed.
