Facts
Janel Heinrich (defendant), a public health officer in Wisconsin, issued an emergency order closing Dane County schools after a new communicable disease, COVID-19, spread across the globe. The order was intended to reduce the spread of COVID-19 in local public schools. Heinrich cited Wisconsin statutory law as the basis for her authority to issue the order. Several Wisconsin citizens (plaintiffs) separately sued Heinrich, asserting that Heinrich was not authorized to issue such an order. The cases against Heinrich were consolidated.
