Facts
Dafro Jefferies (plaintiff), a Black woman, was employed by the Harris County Community Action Association (the association) (defendant). The association failed to promote Jefferies and eventually fired her. Subsequently, Jefferies filed suit against the association, bringing a number of claims under Title VII of the Civil Rights Act of 1964 (Title VII). One claim alleged that the association discriminated against Jefferies on the basis of race and sex by failing to promote her. The district court dismissed the claim of discrimination in promotion. In so doing, the district court relied on statistical evidence indicating that the association did not discriminate against Black men and White women. Jefferies appealed.
