Facts
Jeffrey Milstein, Inc. (plaintiff) manufactured die-cut greeting cards. The cards were folded vertically and die-cut into the shape of a picture of an animal, person, or other object so that the outline of the object also constituted the shape of the card. Greger, Lawlor, Roth, Inc. (defendant) began making greeting cards using a similar design. Milstein sued Greger for trade-dress infringement. The district court denied Milstein’s motion for an injunction. Milstein appealed.
