Facts

Jenison (plaintiff) brought an action for damages against Redfield (water-district directors) (defendant). Jenison received his apportionment of water from the district that would be used in the district without issue. Jenison also owned farmland outside the district that required irrigation. Jenison alleged that the water-district directors refused to distribute a portion of his allocated apportionment of the district’s water. When Jenison attempted to obtain the remaining allocation of his water for use outside of the district, the water district refused to provide Jenison with water. The water-district directors refused to acknowledge that Jenison was entitled to any allocation of the district’s water for use outside the district.
