Facts
Melissa Jennings (plaintiff) was a student-athlete who played on the women’s soccer team at the University of North Carolina at Chapel Hill (defendant). Jennings filed a lawsuit against the university and the women’s soccer coach, Anson Dorrance, alleging sexual harassment and privacy violations. The university filed a motion for summary judgment. In support of its motion for summary judgment, the university filed an affidavit from the university’s registrar and attached Jennings’ transcript to the affidavit to support the university’s assertion that Dorrance dismissed Jennings from the soccer team for Jennings’s academic performance. The university also filed a motion that the registrar’s affidavit and attachments be filed under seal, arguing that Jennings and other students who are mentioned in the affidavit have a privacy interest in the information contained within the affidavit and attachments under the Family Educational Rights and Privacy Act (FERPA). Jennings did not respond to this motion to seal.
