Facts
Jenny Lisette Flores (plaintiff) was the representative party in a class-action lawsuit filed against Attorney General Janet Reno in Reno’s capacity as a representative of the United States government (defendant) on behalf of minors who had been detained by the Immigration and Naturalization Service (INS). The lawsuit challenged the constitutionality of INS policies for detaining and releasing unaccompanied minors and of the government’s treatment of the minors while in INS custody. The United States Supreme Court upheld the constitutionality of the INS regulations on their face and remanded the case for further proceedings. After the case was remanded, and after nine years of litigation, the parties signed a stipulated settlement agreement that set out a nationwide policy for the detention, release, and treatment of minors in INS custody.
