Facts
Jerrico, Inc. (plaintiff) owned restaurants in several states, including Florida. Jerrico registered trademarks for the names Jerry’s Drive-In and Jerry’s Restaurant and used those names for its restaurants. Jerry’s, Inc. (defendant) owned an airline-catering business and some airport restaurants in Florida. Jerry’s used the names Jerry’s, Jerry’s Restaurant, and Jerry’s Caterers for its business but had not registered any of the marks. Jerrico sued Jerry’s for infringing on Jerrico’s trademarks. The district court heard evidence from the parties in order to make a determination about the infringement claim.
