Facts
Drs. Danforth and Ullrich (defendants) wanted to form a corporation. The doctors contacted Douglas Flygt, an attorney with DeWitt, Porter, Huggett, Schumacher & Morgan, S.C. (DeWitt). With Flygt’s help, the doctors formed a corporation called MRIGM. The doctors were shareholders of the corporation. Jean Jesse (plaintiff) sued the doctors for medical malpractice for conduct occurring prior to MRIGM’s formation and otherwise unrelated to MRIGM. Jesse retained Eric Farnsworth, also an attorney with DeWitt, for the lawsuit. The doctors filed a motion to disqualify DeWitt from the case for a conflict of interest.
