Facts
Bruce Rapp, an employee of Jews for Jesus, Inc. (defendant), visited his ill father, Marty Rapp, before Marty’s death. In the Jews for Jesus online newsletter, Bruce wrote that he discussed Jesus with Marty and that his stepmother, Edith Rapp (plaintiff), who was Jewish, accepted Jesus. One of Edith’s relatives saw the newsletter. Edith filed a complaint in state court against Jews for Jesus alleging invasion of privacy by false light, claiming that the newsletter falsely and without her consent asserted that she joined Jews for Jesus and agreed with its principles. The trial court dismissed Edith’s claim with prejudice. Edith appealed, and the appellate court certified the question of whether Florida recognized the tort of invasion of privacy by false light to the Florida Supreme Court.
