Facts
Baidu.com Inc. (Baidu) (defendant) ran a Chinese search engine. Jian Zhang and others (collectively, Zhang) (plaintiffs) published writings online promoting democracy in China. These publications appeared on other search engines but did not appear on Baidu. Zhang sued Baidu for civil-rights violations, among other things, alleging that Baidu intentionally censored and blocked Zhang’s and other pro-democracy content. Baidu moved for judgment on the pleadings.
