Robert Jones and Almarie Jones (plaintiffs), a married couple, sued Amazing Products, Inc. (the manufacturer) (defendant) for products-liability claims of strict liability, negligence, and gross negligence in federal district court for Robert’s injuries when he spilled Liquid Fire drain clearer on himself. Robert transferred the drain clearer to a different container despite product instructions explicitly warning against this on its label. The Joneses alleged the manufacturer failed its duty to warn consumers about the hazards of transferring Liquid Fire to a different container. The Joneses alleged the warning was obscured in a long paragraph and hard to read because of the small font size. Robert testified that he attempted to read the warning label but could not because of the small font. The manufacturer filed a motion for summary judgment in the district court, arguing that the warning was not inadequate as a matter of law because Robert never read it. The Joneses argued that there was a genuine issue of material fact as to whether the warning was adequate due to the small size of the warning’s font.
