Facts
Jordan (plaintiff) lived next door to his father. Jordan’s father bought a used propane storage tank from Canyon Gas and Appliance Company (Canyon) (defendant). When the tank was being refilled by Sunnyslope Appliance Propane & Plumbing Supplies Company (Sunnyslope) (defendant), the propane exploded, destroying Jordan’s house. Jordan brought a products-liability suit based on strict liability against Canyon. Canyon moved for summary judgment on the theory that a dealer in used goods cannot be held strictly liable. The trial court granted Canyon’s motion for summary judgment. Jordan appealed.
