Facts
José Eurípides Parra Parra (plaintiff) filed an action to have Article 140(6) of the Civil Code of Colombia declared unconstitutional. Article 140(6) stated that a marriage shall be null and void if the woman was abducted, unless she consents to the marriage when she is no longer under the abductor’s power. Parra Parra argued that the provision impermissibly discriminated against men who have been abducted.
