Facts
Certain landowners along Nicasio Creek in Marin County, California (the riparian landowners) (plaintiffs) sued Marin Municipal Water District (the water district) (defendant). The riparian landowners claimed that in the past, the natural waters of Nicasio Creek had regularly deposited rock and gravel onto their property, which they then sold, but the water district’s new dam significantly reduced the flow of the creek and prevented it from continuing to deposit this rock and gravel onto the riparian landowners’ property. The riparian landowners requested almost $300,000 in compensatory damages. The district court rejected their claims, and they appealed.
