Facts
Jovani Fashion, Ltd. (Jovani) (plaintiff) designed a prom dress with decorative sequins and crystals applied to the dress bodice and obtained a registered copyright for the prom-dress design. Jovani filed a complaint against Fiesta Fashions (defendant) for copyright infringement of Jovani’s dress design. Jovani argued that the dress had design elements, including its placement of sequins and crystals, that were separable from the useful function of the dress. The district court dismissed Jovani’s claim for failing to meet its pleading burden.
