Facts
International Criminal Court (ICC) prosecutors issued a warrant for the arrest of Sudan’s president, Omar al-Bashir (Bashir), on charges that Bashir committed genocide and other war crimes in the Sudanese region of Darfur. Bashir visited Jordan (defendant) and other countries that would not arrest Bashir, ostensibly because of treaty obligations, Sudan’s refusal to sign the Rome Statute that established the ICC, and international law’s recognition of head-of-state immunity. The ICC Pre-Trial Chamber ruled that Jordan’s failure to arrest Bashir violated Jordan’s obligations as a Rome Statute signatory. Jordan appealed to the ICC Appeals Chamber.
