Facts
L’Alliance (plaintiff) and Prunier (defendant) entered a premium insurance policy on September 28, 1837. Article 15 of the insurance policy required that the parties submit any dispute related to fire damages, experts’ operation, or the execution of the insurance policy to a panel of three arbitrators in Paris. Although Article 15 identified the disputes covered by its terms, the text did not name the three arbitrators. After the signing of the insurance policy, Prunier and L’Alliance had a dispute, and L’Alliance sought to compel arbitration under Article 15 of the September 28, 1837 insurance policy.
