Facts
The Colombia Constitutional Court had the authority to review actions for tutela, a writ intended to protect fundamental, constitutional rights. The constitutional court selected which tutela cases would be considered from the decisions made by all the judges in the country. The process provided an opportunity for the court to create constitutional conformity. In 2008, the constitutional court collected a series of tutelas in which individuals were denied access to healthcare services. These individuals requesting tutelas (plaintiffs) sought the court’s intervention to protect their constitutional right to healthcare. The constitutional court issued decisions on the individual requests for a tutela and ordered the National Commission on the Regulation in Health (the commission) to update its obligatory health plans to ensure the protection of the fundamental right to health.
