Facts
Judith Eunice Espinoza González (plaintiff) filed a paternity suit against Ignacio Andrés Álvarez Diaz (defendant). In support of her suit, Espinoza González filed a sworn statement that she and Álvarez Diaz were in a relationship for over a year. Espinoza González also attached a copy of the child’s birth certificate to her complaint. Álvarez Diaz denied paternity and moved to dismiss the complaint, arguing that there were insufficient facts to make the claim plausible. The lower court denied dismissal, but the court of appeals reversed. Espinoza González appealed the court of appeals’ decision to the Chile Supreme Court.
