Facts
Juliana and others (plaintiffs) brought suit against the federal government (defendant), alleging that the government’s collective environmental policies caused global warming and the rising of the seas, thereby violating the plaintiffs’ fundamental due process rights and the public trust doctrine. The complaint alleged that the government’s acts and omissions resulted in natural disasters, food shortages, and destruction of property, among other things. The complaint alleged that the conduct violated the public trust doctrine because of the government’s failure to protect the atmosphere, water, seas, seashores, and wildlife. The government filed a motion to dismiss for failure to state a claim upon which relief could be granted.
