Facts
Anthony Juliano (plaintiff) and Sandra Juliano (defendant) were divorced pursuant to a settlement agreement. After the divorce, Sandra filed a motion to enforce the settlement agreement. Sandra’s enforcement motion was noticed for, and placed on, the trial court’s motion calendar. At the motion-calendar hearing, Sandra brought a witness to submit testimony relevant to her enforcement motion. Sandra did not provide prior notice to the court or to Anthony that she planned to introduce a witness. Anthony objected to the court taking testimony from Sandra’s witness and moved for a continuance, arguing that he needed time to arrange for his own witness. The trial court denied Anthony’s motion for a continuance, heard testimony from Sandra’s witness, and granted Sandra’s enforcement motion. Anthony appealed.
