Justice for All v. Faulkner
United States Court of Appeals for the Fifth Circuit
410 F.3d 760 (2005)
- Written by Rose VanHofwegen, JD
Facts
The University of Texas at Austin (defendant) adopted a Literature Policy that required all printed materials distributed on campus to bear the name of the school-affiliated person or organization responsible for it. School officials attempted to prevent a student anti-abortion group, Justice for All (JFA) (plaintiff), from passing out leaflets that did not identify JFA as their proponent. JFA brought a federal lawsuit challenging the policy as unconstitutionally restricting anonymous speech in a designated public forum. The district court enjoined enforcement of the policy to prevent JFA from anonymous leafletting, and the university appealed.
