Facts
Lillian Kachmar (plaintiff) was in-house counsel for SunGard Data Systems, Inc. (SunGard) (defendant). After Kachmar’s employment was terminated, Kachmar sued SunGard for retaliatory discharge under Title VII of the Civil Rights Act of 1964 (Title VII). The district court granted SunGard’s motion to dismiss the complaint. Kachmar appealed. SunGard argued that the judgment should be affirmed because, among other reasons, the maintenance of the lawsuit would have required Kachmar to divulge communications with SunGard that were protected by the attorney-client privilege.
