Facts
The Kalinowskis entered into a sales contract to purchase a specific condominium unit from the Yehs. The Yehs failed to deliver on the agreement and did not hand over possession of the condominium unit. The Kalinowskis sued the Yehs, asking for specific performance of the contract. The lower court found in favor of the Kalinowskis and granted specific performance of the contract. The Yehs appealed, insisting that specific performance was an extraordinary remedy that was not appropriate in this case.
