Facts
After finding thrill craft had significantly harmed Hawaii’s waters, Hawaii passed regulations limiting the use of commercial thrill craft, including bans on their use on weekends and holidays. Kaneohe Bay Cruises, Inc. (Kaneohe Bay) (plaintiff) sued, arguing that the regulations violated the Equal Protection Clause by discriminating against Japanese tourists based on their race, national origin, and alienage.
