Facts
Newsweek Magazine, Inc. (Newsweek) (defendant) published an article listing 11 “blowoff” courses that required very little work to achieve a good grade. The article stated that the courses were “good for the grade-point-average” and painless. Kaplan (plaintiff) taught one of the courses named. Kaplan brought suit against Newsweek for libel. Newsweek filed a motion to dismiss. The district court granted the motion. Kaplan appealed.
