Facts
Dr. Katzberg (plaintiff) was a professor of medicine at the University of California at Davis and chair of the radiology department at the university’s medical center. In 1996, the university and local district attorney’s office announced that, after a joint investigation, the radiology department had inappropriately placed $250,000 into the department’s account rather than the medical center’s account. In March 1996, the university announced that unspecified disciplinary action had been taken as a result of the investigation. Later that month, Katzberg was removed as chair of the radiology department but maintained his appointments in the medical school and at the medical center. Katzberg later sued the regents and chancellor of the university (defendant) alleging that, although the chairmanship was an at-will position, stigmatizing statements made in his removal as department chair violated his protected liberty interest under the California Constitution. Katzberg sought injunctive relief and money damages.
