Kellensworth v. State
Supreme Court of Arkansas
631 S.W.2d 1 (1982)
- Written by Sean Carroll, JD
Facts
John Kellensworth (defendant) was charged with rape and burglary. At trial, Kellensworth’s mother testified that Kellensworth “worshipped” his ex-wife. The prosecution then called Vickie Kellensworth, Kellensworth’s ex-wife, for the sole purpose of impeaching Kellensworth’s mother’s testimony. Specifically, Kellensworth’s ex-wife testified that Kellensworth had pulled a gun on her and hit her. The trial court admitted this testimony over Kellensworth’s objection. Kellensworth was convicted. He appealed.
