Facts
A father and son pleaded guilty to defrauding investors of nearly $100 million. Numerous victims submitted victim-impact statements. W. Patrick Kenna (plaintiff) and others spoke at the father’s sentencing about the crime’s impact. The judge would not permit the victims to speak at the son’s sentencing three months later. Kenna filed a writ-of-mandamus petition, seeking an order vacating the son’s sentence and directing the district court to allow the victims to speak at the resentencing.
