Facts
The Pleasant Green Baptist Church (defendant), a congregational church that conducted all business by majority vote, expelled several longtime church members, including Kennedy (plaintiff), from church membership. Kennedy sued, arguing that he was entitled to notice, hearing, and a vote before he could be expelled from the church. The church moved for summary judgment, arguing that a court could not challenge a church’s decision to expel members because that decision was primarily religious. The court ruled in the church’s favor, and Kennedy appealed to the Kansas Supreme Court.
