Facts
Neona Kidd (plaintiff) leased an apartment to Dafford Kennedy. One day, Kennedy had a heart attack and died in the apartment. Kennedy’s body was not found for some time. As a result of the odors and decomposition of Kennedy’s body, Kidd was forced to clean and fully renovate the apartment. Kidd billed Kennedy’s estate (defendant) for the renovation expenses, as well as the rent for the time it took to complete the work. After the claim was disallowed, Kidd brought suit seeking to collect the claimed amounts. Kennedy’s estate filed a demurrer, which the trial court overruled. Kennedy’s estate appealed.
