Facts
In 1977, Kenneth P. Yeager (plaintiff) was offered a job at the Bell Helicopter International Company (BHI) to provide management and support to operations in Tehran, Iran (defendant). Beginning in late 1978, American citizens in Iran began to be subject to increasing harassment. In 1979, men claiming to be revolutionary guards acting on behalf of the “new government” forced Yeager and his wife out of their apartment and into a hotel, where the Yeagers were held for days. Eventually, Yeager was evacuated to Germany. Yeager brought this claim against the government of Iran. Iran claimed that the revolutionary guards were not authentic and that the guards’ conduct was not attributable to Iran.
