Facts
In 1998, Kentucky Legal Systems Corporation (KLS) (defendant) recorded a judgment lien against all property owned by Dunn. In 2000, Dunn bought a property subject to a mortgage held by Community Trust Bank (the Bank) (plaintiff). Dunn defaulted, and the Bank foreclosed. The Bank sought a declaratory judgment that its mortgage was a purchase money mortgage and had priority over KLS’s judgment. The circuit court ruled in favor of the Bank. KLS appealed.
