Facts
While at a friend’s house, Dawn Kessler (plaintiff) was using a pressure cooker manufactured by National Presto Industries, Inc. (Presto) (defendant) when the pressure cooker exploded and injured Kessler. Kessler met with a representative of her friend’s homeowner’s insurance company and executed a Release of All Claims in exchange for $750. The Release stated that Kessler released her friend and all other persons, corporations, firms, associations, or partnerships from any and all claims arising out of her injuries. Subsequently, Kessler sued Presto in district court for products liability. Presto moved for summary judgment, alleging that Kessler’s claim was improper based on the release that Kessler had signed.
