Key Publications, Inc. (plaintiff) published a yellow-pages directory for the New York Chinese American community. Ms. Wang, who was responsible for assembling Key’s directories, collected business cards from business establishments associated with the Chinese American community and other establishments she thought ought to be included. The information collected was sorted by type of business and placed in one of over 260 different categories, and each of the approximately 9,000 listings consisted of an English and Chinese name, an address, and a telephone number. Galore Enterprises, Inc. (defendant) also published a yellow-pages directory listing business establishments of interest to the New York Chinese American community. The Galore directory contained approximately 2,000 listings divided among 28 different categories, 1,500 of which listings were also included in the Key directory. The district court held in favor of Key on its copyright-infringement claim. Galore appealed.
