Facts
The son of Roger and Bonnie Kays (plaintiffs) died in an accident while riding a jet ski rented from Keys Jet Ski, Inc. (Keys) (defendant). The Kayses sued Keys for damages. Keys argued that a jet ski was covered by the Limitation of Liability Act, which limited Keys’ liability. The jet ski itself was seven feet long and capable of carrying people on water at speeds up to 35 miles per hour. The district court ruled in the Kayses’ favor, finding that the jet ski was a pleasure craft and that the act did not cover pleasure craft. Keys appealed.
