Facts
The Crown (plaintiff) charged Khaliq with selling glue and paraphernalia for inhaling vapors from the glue to several children between eight and 15 years old. The paraphernalia included tins, tubes, and plastic bags. Khaliq filed a challenge to the indictment. Khaliq argued that the acts alleged in the indictment did not constitute a crime under the laws of Scotland. The trial court denied the challenge, and Khaliq appealed to the High Court of Justiciary.
