Facts
Kiki Undies Corporation (Kiki) (plaintiff) registered several trademarks that included the name Kiki in connection with the manufacture, sale, and distribution of women’s apparel, including hosiery. Thereafter, Promenade Hosiery Mills, Inc. (Promenade) (defendant) also used the term Kiki as a trademark without Kiki’s consent in connection with the sale, distribution, and advertisement of women’s apparel. Kiki sued Promenade for trademark infringement and sought injunctive relief. After finding that Promenade had infringed Kiki’s trademarks, the district court turned to Kiki’s request for an injunction.
