Facts
Regina Kilmon (defendant) took cocaine while pregnant and gave birth to her child a few hours later. After birth, a drug screen showed that the child had cocaine in his blood. Kilmon was charged with the crime of reckless endangerment. Specifically, the state (plaintiff) alleged that Kilmon’s act of taking cocaine while she was pregnant had recklessly endangered the health of her child after his birth. Kilmon was sentenced to four years in prison. Kilmon appealed, and her appeal was consolidated with another, similar appeal.
