Facts
In response to the COVID-19 pandemic, Indiana University (university) (defendant), on the recommendation of a committee of experts, enacted a vaccine mandate for all faculty, staff, and students at the university. Any unvaccinated individuals were barred from campus, had their campus emails and accounts suspended, and had their access-cards revoked. Students could seek medical or religious exemptions but were then subject to increased testing, masking, and social-distancing requirements. Eight students (plaintiffs) filed suit against the university, claiming that the vaccine mandate violated their constitutional rights. The students sought a preliminary injunction to prevent the university from enforcing the mandate. In its preliminary-injunction evaluation, the court addressed whether the students were likely to succeed on the merits of their claims.
