Facts
Crucible, Inc. (Crucible) (plaintiff) held a patent. Crucible sued Stora Kopparbergs Bergslags AB and Stora Kopparberg Corp. (collectively, Stora) (defendant) for infringing the patent, and the district court issued an order enjoining Stora and its successors in interest and assigns from infringing the patent. Stora then formed a subsidiary, Kloster Speedsteel AB (Kloster), that bought the building where Stora was making the products that infringed Crucible’s patent. Kloster intervened, and Kloster and Stora moved to modify the court’s injunction order, arguing that by including successors and assignees, the trial court exceeded the scope of Federal Rule of Civil Procedure (FRCP) 65(d) in its order. The trial court denied the motion, and Kloster and Stora appealed.
