Facts
Knight (plaintiff) brought a negligence suit against Jewett (defendant) for injuries she sustained during a touch football game. Knight alleged that after she caught a pass, Jewett ran into her from the rear, knocked her down, and stepped on her hand. Jewett claimed he collided with Knight in an attempt to intercept the pass. Jewett moved for summary judgment and argued that Knight assumed the risk of injury by participating in the game. The trial court granted Jewett’s motion, and after Knight appealed, the trial court’s decision was affirmed by the court of appeal.
