New York City Court
194 Misc. 942, 83 N.Y.S.2d 297 (1948)
- Written by Daniel Clark, JD
Facts
American Export Lines, Inc. (defendant) was operating a ship under an agency agreement with the United States, the ship’s owner. Eino Koistinen (plaintiff) worked on the ship as a seaman. While on shore leave, Koistinen became intoxicated and got into a payment dispute with a woman working as a prostitute. During the dispute, the woman locked Koistinen in her room. When the woman returned with a physically imposing man, Koistinen sought to escape by leaping out of the window. Koistinen suffered injuries and was hospitalized. American Export Lines covered Koistinen’s wages and hospital bills. When American Export Lines resisted paying Koistinen maintenance, Koistinen sued.
