Facts
Under Swedish law, alcoholic beverages could not be advertised on television or radio or in periodicals unless the periodical was distributed at the point of sale of alcoholic beverages. Gourmet International Products AB (Gourmet) (plaintiff) brought a case in connection with the law before the Stockholm district court. Gourmet argued that the law restricted imports in violation of European Union (EU) law and was not justified on public-health grounds because the law effectively constituted a complete ban on advertising alcoholic products and was therefore disproportionate to the public-health goals. A preliminary ruling from the European Union Court of Justice was requested.
