Facts
Ms. Berlin (defendant) approached a six-year-old girl, Wendy Korbin (plaintiff), and said that Korbin’s mother was taking a man away from his wife, that Korbin’s mother would be punished by God, and that Korbin’s mother was sleeping with the married man in Korbin’s room. It is alleged that Berlin made these statements willfully and maliciously, that Berlin’s statements were false, and that Berlin knew they were false. Korbin, through her guardian and next friend, brought suit. The trial court dismissed the case, holding that Korbin did not state a cause of action. Korbin appealed.
