Facts
Robert Kostelecky (plaintiff) was injured while working on an oil rig operated by N.L. Acme Tool Company/N.L. Industries, Inc. (NL) (defendant). Jester Beck was an eyewitness to the accident. Kostelecky brought a negligence suit against NL. At trial, NL introduced, over Kostelecky’s objection, a report filled out by Beck. In the report, Beck stated that Kostelecky’s conduct had caused the accident. The jury found in favor of NL. Kostelecky appealed.
