Facts
Hendrik Koster (plaintiff), a Netherlands citizen, alleged that Automark Industries, Incorporated (Automark) (defendant), an Illinois company, had entered into a contract with Koster for the sale of tire gauges manufactured in Switzerland. The purported contract was negotiated and signed in Italy. Automark did not conduct any business activities in the Netherlands. Before signing the document, Automark communicated with Koster in the Netherlands about scheduling a meeting to discuss the terms of the sale. The purported contract contained language indicating that Automark promised to pay Koster in the Netherlands. Koster filed suit against Automark in the Netherlands, claiming that Automark had breached the contract. The Netherlands court entered a default judgment against Automark. Koster subsequently commenced an action against Automark in the United States, seeking to enforce the Netherlands court’s default judgment. The district court granted summary judgment in favor of Koster and enforced the default judgment. Automark appealed.
