Facts
The City of Trenton, New Jersey, adopted an ordinance that prohibited any person from using a sound truck or other instrument that emitted loud and raucous noises on any public street. Cooper (plaintiff), a police judge of the City of Trenton, found Kovacs (defendant) guilty of violating the ordinance. The New Jersey Supreme Court upheld the conviction, which the New Jersey Court of Errors and Appeals affirmed. The United States Supreme Court granted certiorari.
